Right of Cancellation for Consumers

(A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.)

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day

• on which you or a third party named by you, who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly, or
• on which you or a third party named by you, who is not the carrier, have taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately, or
• on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, provided that you have ordered a good that is delivered in several partial shipments or pieces, or
• on which you or a third party named by you, who is not the carrier, have taken possession of the first good, provided that you have concluded a contract for the regular delivery of goods over a specified period.

To exercise your right of cancellation, you must inform us (Shimal Tea Agata Zyznowska, Königinallee 96, 71638 Ludwigsburg, Germany, Telephone number: +491604112806, Email address: shop@shimaltea.de) by means of a clear declaration (e.g. a letter sent by post, email) of your decision to cancel this contract. You can use the attached sample cancellation form for this purpose, but it is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

Consequences of Cancellation

If you cancel this contract, we shall reimburse to you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your cancellation of this contract. For this reimbursement, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
